Areas of expertise:

Divorce in Kentucky
Kentucky operates as a "no-fault" divorce state, meaning that neither party needs to prove wrongdoing to file for divorce. The primary requirement is that the marriage is "irretrievably broken." At least one spouse must have been a resident of the state for a minimum of 180 days before filing.

Child Custody and Shared Parenting
Kentucky House Bill 528, enacted in 2018, established a rebuttable presumption that joint custody and equally shared parenting time are in the best interest of the child. This law positions Kentucky as a leader in promoting shared parenting arrangements.

Child Support Guidelines
Child support in Kentucky is calculated based on both parents' combined and relative incomes, the number of children involved, and the parenting schedule.

Spousal Maintenance (Alimony)
Kentucky courts may award spousal maintenance, also known as alimony in other jurisdictions, based on factors such as the length of the marriage, each spouse's financial resources, and their ability to meet their own needs independently. Maintenance can be temporary or long-term, depending on the situation.

High-Asset Divorce
Divorces involving significant assets, such as business ownership or substantial investments, require careful financial planning and asset distribution. Attorneys experienced in high-asset divorces handle complex issues like business valuations and equitable distribution of property.

Paternity and Fathers’ Rights
Establishing paternity is crucial for fathers seeking custody or visitation rights. Legal acknowledgment of paternity can be established through voluntary acknowledgment or court proceedings. Fathers may also seek to assert their rights in custody and support matters.

Domestic Violence and Protective Orders
Victims of domestic violence can seek protective orders through the family court system. In 2017, Jefferson County reported 5,015 domestic violence cases, highlighting the importance of legal protection in such situations.

Grandparents’ Visitation Rights
Grandparents may petition for visitation rights, especially when family dynamics change due to divorce or separation. Courts consider the best interests of the child when determining the appropriateness of grandparent visitation.
